Activist Okiya Omtatah yesterday sued to stop the implementation of the two-thirds gender rule.
In suit papers, he wants the court to suspend orders given by Justice Mumbi Ngugi, directing compliance of the Supreme Court’s advisory opinion issued in December last year.
Omtatah said the advisory by the highest court is erroneous, which could lead to an amendment of the constitution.
On June 26, Ngugi ordered Attorney General Githu Muigai and Commission for the Implementation of the Constitution chairman Simeon Nyachae, to enact laws on the gender rule within 40 days.
Omtatah said the court cannot order the AG and CIC to comply with the Supreme Court advisory.
