A 26 years old man was on Tuesday sentenced to 20 years in jail by a Kigumo court for defiling a minor back in 2013.
James Muriu was accused of defiling and impregnating a 15 years old girl who was also his neighbour in Ikumbi village, Kigumo Sub County in Murang’a County. The girl later gave birth.
The court heard that the man committed the offense between December 2013 and May 2014 but while testifying, the girl said that the accused was her boyfriend since the time she was in class eight and that she had gone to visit him willingly.
She said that the parents of the accused had on several occasions asked her mother to allow them educate her and provide for her when they learnt that she was pregnant but her mother declined the offer.
She also claimed that the accused helped her with medical bill and other expenses for the child and that the relationship had continued for a long time adding she still loves him and would not want to see him imprisoned. She claimed that she did not know the consequences of the act at that time.
The accused on his part pleaded for leniency, saying that the complainant was his girlfriend and the parents knew about the relationship.
He pleaded for a non-custodial sentence so that he could continue providing for his child and the mother.
The prosecution had however, proved him guilty and the Chief Magistrate, Agneta Ogonda sentenced him accordingly.
The sexual offenses act dictates that a person who defiles a child aged 11 years and below shall upon conviction be sentenced to life imprisonment while one who defiles a child aged between 12 and 15 years gets not less than a 20 years’ jail term. Muriu falls under the latter category.
One who defiles a child between 16 and 18 years of age gets not less than 15 years in jail.
