A 40-year-old man who defiled a mentally impaired 12-year-old girl in Kebulonik location of Nandi County several years ago was on Friday sentenced to serve 20 years in jail by a Kapsabet court.
The convict, Eliud Kipkosgei Bett, who committed the offense seven years ago but delayed the trial after jumping bail for two years was found guilty of having sexually abused the minor and infecting her with a sexually transmitted disease.
He was caught red-handed by the girl’s elder brother defiling her in her living room at Rubet village on the evening of November 1, 2010.
The court was told, on the material day the accused who was a neighbor to the complainant, took advantage of the fact the girl had been left alone at home when her mother sent the brother who used to be the caretaker to grind flour at the village posho mill while the mother proceeded on an errand to fend for the children.
Bett fought and overpowered the girl’s brother when the he stumbled upon him in the act of defilement upon his return to the home before escaping.
Upon conviction, the accused pleaded for leniency, saying he is a father and the family sole breadwinner.
The Kapsabet Senior Resident Magistrate, Maureen Jerono said the law clearly spells out the kind of sentence to be meted out in such circumstances to deter others with similar intents.
She reminded him the right to appeal the sentence within two weeks as provided in the law.
