Former Nyandarua Governor Daniel Waithaka and two county officials Thursday spent the better part of the day being grilled at the Nyeri Regional EACC Offices over corruption related charges.
The move followed a recommendation by the Director of Public Prosecution Noordin Haji to have them arrested and arraigned in court for flouting procurement laws.
Waithaka and the two CECs presented themselves before EACC detectives followings summons issued against them in connection with Sh50.4 Million illegal tender award in 2014.
The Governor, former Water, Energy, Environment and Natural Resources CEC, Grace Gitonga and serving County Officer, Kihiu Gaiko are alleged to have illegally awarded the multi million tender to Tahal Company Engineers LTD for construction of a Sewerage system at Ol Kalou Town.
The three including one who did not appear for grilling are alleged to have awarded the tender without a procurement plan or funds for purposes of the said project for the financial year 2013/2014.
The relevant procurement law under the public procurement and disposal act 2015 were flouted in procuring the services of Tahai consulting engineers limited,” read part of the charge.
It is also said that the company was paid the amount in two instalments in 2014 and 2015 despite being not a lawful entity at the time of the transactions.
All the payments are said to have been made to the company without requisite and proper authorization in breach of Public Finance Management Act.
The payments are also said to have been made before supporting documents were presented.
The team is also accused of neither seeking nor obtaining the approval of the private public partnership prior to the signing of the contract on April 30, 2014.
Upon my perusal and independent consideration of the evidence contained in the inquiry file, am satisfied that there is sufficient evidence to charge the above named persons,” noted the DPP in the press statement.
