A Lebanese national who has been on the run, after allegedly defiling a 15- year- old girl, was Tuesday arraigned in a Nakuru Court and charged with the offence.
Sheikh Mourtada Mustafa Mourtada, was arrested on March 2,2018, at Moi International Airport in Mombasa and arraigned in a Nakuru court to answer to the charges levelled against him.
Mourtada is alleged to have committed the offence on July19, 2012 in Nairobi, a charge that was strongly opposed by defence counsel, Cliff Ombeta.
According to the prosecution, the accused had promised to help the minor travel to Lebanon in search of green pastures, but he instead took her to Nairobi, where he defiled her.
It is alleged that the accused person worked in cohorts with the headmaster of a private academy in Nakuru, who was the link between the girl and the accused person.
The suspected head teacher has since been jailed for 10 years by a Nakuru court for his involvement in trafficking girls for sex to foreign nationals.
The defense, the counsel opposed the allegations, saying that his client was not the person being sought by the prosecution.
Mr. Ombeta told Principal Magistrate, Joel Omido that the person being sought bore different names, and urged the court to release the accused person on bond, as police undertake further investigations.
He told the court that the person being sought was Sayyid Mourtada Mustafa Mourtada and not his client identified as, Sheikh Mourtada Mustafa Mourtada.
He further alleged that his client was a well-known person, and both his residence and place of work were well known, and therefore police would have been able to get him if they wanted to. He also wondered why it had taken 6 months for the crime to be reported, yet the alleged offence was reported on December 5, 2012.
He further added that he was ready to present his client’s passport to the court to ensure that he did not abscond court sessions.
The magistrate released the accused on a bond of Sh800, 000, pending hearing of the case, which will commence on May 28,2018.
