Father sentenced life imprisonment for defiling his two daughters

A middle aged man was sentenced to a life imprisonment after he was found guilty of defiling his two underage daughters.

Nicodemus Kombe Kiboni who appeared before Senior Principal Magistrate, Dominica Nyambu had been charged with incest.

On the first account the court heard that on diverse dates between 1st April 2010 and 1st January 2011 at Majaoni village, Mtondia sub location within Kilifi County, the accused who lived alone with his children after he had separated with their mother repeatedly defiled his firstborn daughter who was nine years and in class three at that time.

It was heard that on each occasion the accused would defile his daughter he would claim that he was ‘checking’ if the girl was a virgin or not.

On the second account the accused was charged that on diverse dates between 1st January 2008 and 31st December 2010 he defiled his other daughter severally who was seven years at that time.

In her judgment the senior principal magistrate Dominica Nyambu found the accused guilty of two accounts of incest contrary to section 20(1) of the sexual act no.3 of 2001 and two alternative counts of committing an indecent act with a child contrary to section 11(1) of the sexual offence act no.3 of 2006.

She sentenced the accused to a life imprisonment but granted him the right to appeal within 14 days.

The accused is expected to serve his jail term at Shimo La Tewa Gk Prison.
