A Kwale Court Friday rejected the prosecution’s application barring the release of 42 suspected members of the Mombasa Republican Council (MRC) on a bond of Sh 200,000 each.
Hamadi Hassan Mwatando and forty- one others were charged that on December 31, 2014 in Tiwi location Kwale County, they unlawfully took part in unlawful assembly and were also found to be members of outlawed sect (MRC).
Kwale Resident Magistrate Mr. Paul Mutai noted that every citizen has a right to be granted bond until proved guilty.
The magistrate added that the prosecution and the intelligence report did not provide any substantial evidence to support their allegations that the suspects were planning to cause chaos and would recruit members to MRC if released on bond.
He however cautioned the suspects to desist from engaging in acts which are similar to in nature to the same charges they are facing.
The magistrate further directed the orderlies to continue detaining the suspects in Shimo la Tewa GK prison pending the approval of the bond terms.
The case will be mentioned on January 22, and hearing fixed on March 21, 2016.
