A 30 year old man who was found guilty of defiling his 9 year old daughter has been sentenced to serve 10 years imprisonment by a Kitale court.
Paul Ekaale Selo was charged with defiling his standard three nine year old daughter on diverse dates between January and March 2017 at Kiriita farm in Makutano location within Trans Nzoia County.
In her ruling, Senior Resident Magistrate Dorcas Wangeci found the accused guilty of both incest and defilement.
The court heard that the accused took advantage of the absence of his wife, who the court heard had gone to attend a funeral of some relatives, and defiled the girl on his matrimonial bed.
The girl had told the court in a private session that at around 4pm on the material day, her father sent her other two brothers to fetch firewood and took her into his bedroom where he undressed her, before defiling her several times.
The victim had further told the court that it was not the first time the father was defiling her, although she had kept it away from the mother.
Earlier when the accused was arrested and arraigned in court, he had pleaded not guilty and was released on a bond of Sh300, 000 with same surety.
Human Rights Activist for Centre of peace and justice, Boniface Wanyoike lauded the court ruling saying it will sound as a warning to others with same mind.
Most of the gender based violence cases are committed by close relatives and the neighbors, he said, adding that the penalties should be much higher.
In his mitigation, the accused prayed for pardon saying his children and siblings who are in primary school depend on him.
